Welcome to Smart Indian, a Human Identity Verification and Digital Identification service. By using our website, mobile application, verification system, Smart Indian Card, or any service under Smart Indian Venture, you agree to the following Terms & Conditions. Please read them carefully.

1. Acceptance of Terms : -
By accessing or using Smart Indian services, you agree to be bound by these Terms & Conditions, our Privacy Policy, and the Refund Policy. If you do not agree, please do not use our services.
Nature of Service : -
Smart Indian provides:
Identity verification services (API + manual verification)
Digital and physical ID card issuance
Member verification for employers
Background authenticity checks
Smart Indian is NOT a government ID and must not be used as a substitute for Aadhaar, PAN, Voter ID, or any official document.
3. Eligibility for Membership : -
To register as a member, you must:
Be an Indian citizen or legally residing in India
Provide accurate and authentic personal information
Agree to the verification process
Be at least 18 years old (or have parental/guardian consent if below 18)
Smart Indian reserves the right to accept or reject membership applications.
4. Duties of Members : -
Members must:
Provide honest and correct information
Not misuse the Smart Indian Card or brand name
Not engage in fraudulent or illegal activities
Update information if any changes occur
Use the identity card only for permitted purposes
Misuse may lead to membership cancellation and legal action.
5. Verification Process : -
Smart Indian verifies user identity through:
Government & authorized APIs
Manual background verification
Document authentication
Face/photo matching
A Smart Indian Card is issued only after successful verification.
6. Restrictions on Use : -
You are not allowed to:
Use Smart Indian services for unlawful purposes
Create fake or duplicate profiles
Share or sell your Smart Indian Card
Manipulate or tamper with documents
Claim Smart Indian as a government authority
Doing so will result in termination and legal action.
7. Data Usage & Privacy : -
Your personal information is collected solely for:
Identity verification
ID card issuance
Security checks
Communication related to your membership
Smart Indian:
Does not sell member data
Shares data only with verification partners or when legally required
Protects user data with strict security protocols

8. API Usage (For Businesses & Developers): -
Businesses using our verification API must:
Use it only for legitimate verification
Not store or misuse identity data
Maintain confidentiality and security
Pay applicable API usage fees
API misuse will result in:
Immediate suspension
Legal action
No refund for consumed credits.
9. Membership Cancellation : -
Smart Indian may suspend or terminate membership if:
False information is submitted
Documents are forged or illegal
Card is misused
Member violates any terms
Fraudulent activity is detected
Members may also opt to cancel membership voluntarily.
10. Refund Policy : -
Refunds will be governed as per the Refund Policy, including:
2× membership fee refund only in case of verified data leakage caused by Smart Indian
No refund for false information, misuse, or fraudulent documentation
API usage refunds only for technical errors.
11. Disclaimer : -
Smart Indian:
Is NOT a government agency
Does NOT provide government identity
Does NOT promise employment or financial benefits
Is NOT responsible for misuse by members or third parties
The Smart Indian Card is strictly for private identity verification purposes.
12. Limitation of Liability : -
Smart Indian is not liable for:
Losses due to misuse of the card by the member
Incorrect data provided by the user
Delayed verification due to external sources
Technical issues beyond our control
13. Changes to Terms : -
Smart Indian reserves the right to modify these Terms & Conditions at any time.
Updated versions will be published on this page.
Continued use of our services constitutes acceptance of updates..
14. Governing Law : -
These Terms are governed by Indian laws, and any disputes will be handled under the jurisdiction of courts located in Kolkata, India..
